Hi, I'm working on filing a chapter 7 claim myself. I am having a hard time figuring out how to include my $2500 saxophone (my only valuable possession) under the tools of the trade exemption (600 in New York).
What's confusing to me is that every lawyer I've consulted with tells me that it'll be no problem to keep the sax. Unfortunately none of them would describe how that would work (probably for legal reasons they can't).

These people are the worst to deal with! They were included in my BK7 and they foreclosed 1 day before the BK7 filing!

I sent them a letter telling them that they are listing a balance on my EX TL and after I checked my PG report, they are also reporting a balance on my EQ report and listed it as OPEN!
Can I sue them for listing a balance on BK7 account even if they foreclosured 1 day BEFORE the BK7 filing???
I haven't been around awhile, been fighting the good fight but now we're tired. When you go to a lawyer do they explain everything? Is there anything we can do to protect some of our stuff, the things that really matter to us?

Today I did a file for a customer that had a bk7 discharged in 2005 (just over three years ago) and he was in a 30 yer fixed. His interest rate was pretty good, only .25 of a point over the going rate for government backed loans right now. I found it to be pretty encouraging and thought others may also, so I decided to post.

Ok, I will be filing and will receive my stay by end of next week. My mortgage company received a default judgement (I filed answer 1 day late ), My house is set to auction on 11/28/05.
When the automatic stay takes effect, I know that the stay will cancel out the sherriff's sale. I have no intentions of keepting the house. How long will it take for them to get the stay lifted? Do they have to wait for the 341 meeting? Do they have to post for 30 days then set sherriff sale again

My mother lost her house and now lives with me, but household income from me would put her over the income limits for a 7. her back is screwed and we are gonna shoot for SSD for her. If she gets on it can it be garnished? If not she can skip the BK altogether I would imagine.
